Areas of Practice: Arson and Fraud

In many states, in order to establish a prima facie case of arson for the purpose of denying coverage, an insurer must prove that: (1) the loss was intentionally caused; (2) that there was motive and opportunity by the insured for causing the loss; and (3) that there is either direct evidence or adequate circumstantial evidence to infer that the insured was guilty of misconduct in the origin of the loss. In that regard, this section of InsuranceFraudLaw.com examines the legal issues that arise when a coverage defense on the basis of arson or fraud is asserted.
